4A. Text Messaging (SMS/MMS), Phone Calls, and Email

Brisk Architectural Inc. communicates with customers, clients, vendors, employees, and other contacts by text message, phone, and email for purposes such as project updates, scheduling, customer support, account and service notices, and internal and HR notices. Our text messaging program is called Brisk Architectural Messaging. Brisk telephone numbers used for these communications include +1 941-401-4015. Program details, opt-in, and opt-out instructions are in our Communications Terms & Conditions.

a) Information We Collect Through Communications

• Text messages (SMS/MMS): your mobile phone number; the content of messages you send and receive, including any images or files sent by MMS; opt-in and opt-out records (including how and when consent was given or withdrawn, and the keywords used, such as STOP, START, or HELP); and message timestamps and delivery status.
• Phone calls: your phone number; call date, time, and duration; and, where you have been notified, call recordings, transcripts, and summaries, including calls placed or answered by an automated or AI voice assistant.
• Email: your email address and name; the content of emails you send us; and records of your email preferences, including unsubscribe requests and their dates.
• Any other information you choose to share with us in a text, call, or email.

b) How We Use Communications Data

• To respond to your messages, calls, and emails and to provide the information or support you request
• To send project updates, scheduling and appointment messages, service and account notices, and, for employees, HR and other internal notices
• To record, document, and honor your consent and opt-out choices
• To maintain quality, train staff, keep business records, prevent fraud and abuse, and comply with legal obligations

If we send promotional messages, we do so only where the law allows and only with any consent the law requires, and you can opt out at any time.

c) Phone Calls, Call Recording, and Automated or AI Voice Calls

Calls to or from Brisk may be recorded, transcribed, and/or summarized for quality assurance, training, and record-keeping. We will tell you at the start of a call when it is being recorded. Where the law requires the consent of all parties to record a call, we will ask for your consent, and you may decline or end the call. Some calls may be placed or answered by an automated or AI voice assistant on behalf of Brisk, and we will identify such calls as automated.

Brisk makes calls and sends texts using an automatic telephone dialing system, an artificial or prerecorded voice, or an AI-generated voice only with your prior express consent, or prior express written consent where the Telephone Consumer Protection Act (TCPA) or other law requires it. Consent to receive these calls or texts is never a condition of purchasing any goods or services, or of employment. You may withdraw consent at any time by any reasonable means, including replying STOP to a text, telling us during a call, or contacting us using the details below. We honor these requests promptly and within the time required by law. We also keep an internal do-not-call list.

d) Email Communications

Our emails identify Brisk Architectural Inc. as the sender, use accurate header and “From” information and subject lines that are not misleading, and include our physical mailing address. Any commercial or promotional email we send includes a clear unsubscribe link or instructions. We honor unsubscribe requests within 10 business days, and we do not sell or transfer the email addresses of people who unsubscribe. Even after you unsubscribe from promotional email, we may still send transactional or relationship messages, such as project, account, or service notices, or messages related to your employment.

e) Sharing of Communications Data

We never sell your phone number, your text messages, your call recordings, or your opt-in information. Service providers that help us deliver communications, such as our SMS, voice, AI assistant, and email platform providers and telecommunications carriers, process this information only to provide the service on our behalf and may not use it for their own purposes. We may also disclose information when required by law or to protect our rights, property, or safety.

f) Retention of Communications Data

• Text message and email content, call recordings, transcripts, and summaries: kept for as long as needed for the purpose they were collected (for example, the life of a project, the business relationship, or employment) and generally no longer than 24 months after that, unless a longer period is required by law or for HR, legal, or contractual record-keeping.
• Consent, opt-in, opt-out, and unsubscribe records (including timestamps): kept for at least five years after your last interaction with us so we can show that we honored your choices.

g) Security and Your Choices

We protect communications data with the measures described in Section 6. To stop text messages, reply STOP to any message from us. For help, reply HELP or email wpajor@briskarch.com. To stop calls, tell us during the call or contact us. To stop promotional emails, use the unsubscribe link in the email. Please do not send sensitive information, such as Social Security or bank account numbers, by text message.
